Andy was sited again. This time the same DEC officer observed a deer eating something off a small table at the end of our dock. Our next door neighbor's grandchildren asked if they could feed the ducks and geese so my Dad gave them some bread. Well the kids left some bread on the table and guess what!!!! A deer found the bread,and at the same time that same DEC Officer seen the deer on the dock, and you'll never guess what happened next. YUP! The Deer Man was arrested again!!!!
Thank GOD, this is a Free Country, Otherwise he might have been shot on the spot! This type of harassment has gone too far. The New York State DEC is trying to impose GESTAPO tactics on our Constitutional Rights. This is pure hasassment! Please, write the Governor of the "I Love New York" State to stop harassing this 82 year old man who loves God's creations. Your support will help us to bring back the the FREEDOM we payed so dearly for.

New York's Herkimer County Judge Patrick Kirk reversed Judge
Smith's guilty decision on a lack of evidence and the charges were
dropped on my dad.We are now no better off because we still have to abide by this badly
written law. The only way to allow my dad toreturn to the year
round feeding program
is to change the wording
of the law. Although the
law states "HIGHWAY"
and PUBLIC ROAD,
even though we live on a
dead end road, posted at
15 MPH and the road ends
205 feet past our property
we don't dare to feed any
of the wild life. If we put
out bird seed or bread for
the squirrel's and turkeys we fear that he will be arrested again if a deer
wander's over and is seen eating the seeds or bread.Andy has been in contact with Senator Charles E. Schumer and he said
he would look into this matter a few months ago, as
yet we have not heard anything.I would like to add to this update a very special thanks to all the
Guestbook comments and to all the E-Mail that concerned
people have sent my dad on his plight to be able to return to
feed the deer. This month alone he received over 300 E-mails,
I wish you could see how much he enjoyed reading each and everyone.
Also I would like to add a thank you to all the people who wrote and wanted
to send money to help pay for the legal fee's and those who volunteered
to serve the jail time if it went that far.And to all the people who stated that they will not visit Old Forge because
of this law. Andy usually has 800+ visitors come each year and since this
happened only 40 some visited this year. Some people did in fact send
money, and my dad did return the money. I feel that the only way to change this law
would be to have support from concerned people to write to Senator
Schumer or E-mail at senator@schumer.senate.gov and voice their opinion

Sorry for not writing sooner, I've been out of state.
As for Andy's court case the judge ruled that by him placing bread and
corn on the picnic table to feed the birds and squirrels he was found
guility of "Attracting Deer".Judge Smith stated that if any food of any type, no matter who put it
there or how it got there it's up to the land owner to police it up so
not to attract deer.So if you have an apple tree within 300 feet of a Highway and you have
deer feeding on the apples that have fallen to the ground, you can be
arrested for attracting deer. He stated it's up to the land owner to
keep the apples off the ground.Andy was fined $25.00 and appelled the court. We are still waiting for a
new court date, which another judge in Herkimer will hear the case.
Thanks again for your help letting the WORLD know of Andy's injustice of
a badly written law.Fred
